Appellate Court Grants Rare Reversal Following Commercial Arbitration
On March 12, 2015, Sher Tremonte obtained a rare reversal from the First Department Appellate Division following an unfavorable arbitration award against its client, a real estate investor. On appeal, Sher Tremonte sought to vacate the Commercial Division’s confirmation of the award on the ground that the court and the arbitrator lacked personal jurisdiction over the investor, in part, because the investor had not personally agreed to resolve disputes through arbitration. The Appellate Division granted Sher Tremonte’s appeal and ordered the Commercial Division to hold a hearing concerning personal jurisdiction. Read the opinion here.
