Sher Tremonte Wins Dismissal of Internet Defamation Lawsuit for Social Media Firm
On December 16, 2015, the U.S. District Court for the Eastern District of New York granted summary judgment in favor of Sher Tremonte’s client in a lawsuit seeking $5 million in damages. The case involved accusations by a law firm that Sher Tremonte’s client, a public relations and social media firm, had posted defamatory remarks on an Internet comment thread concerning a mass action lawsuit brought by the plaintiff. The court dismissed the action in its entirety, finding in favor of Sher Tremonte’s client that the challenged remarks constituted non-actionable, protected speech under the First Amendment and the New York State Constitution.
