Sher Tremonte Scores Another Victory for Congressional Committee Investigating January 6th Attack

On May 1, 2022, Sher Tremonte obtained dismissal of all claims brought by the Republican National Committee against the U.S. House of Representatives Select Committee to Investigate the January 6th Attack on the United States Capitol.

The Select Committee had subpoenaed Salesforce.com for records relating to the joint effort by the RNC and the Trump campaign to send hundreds of emails leading up to the January 6 attack that falsely suggested the 2020 presidential election had been stolen. The RNC sued the Select Committee and Salesforce.com and sought a preliminary injunction to stop Salesforce from producing records in response to the subpoena.

Working with the Office of the General Counsel for the House of Representatives and Arnold & Porter, Sher Tremonte prepared the Select Committee’s response to the motion for preliminary injunction. In addition to opposing the preliminary injunction, Sher Tremonte sought dismissal of RNC’s claims on the ground that they were barred by the Speech or Debate Clause of the Constitution.

Judge Timothy Kelly adopted Sher Tremonte’s arguments in full: “The Court has little trouble concluding that the Speech or Debate Clause immunizes House Defendants from this suit and that they must be dismissed for that reason.”
