Sher Tremonte Wins Dismissal of All Claims Against International Jewelry Retailer

New York, NY – March 13, 2026 – Sher Tremonte LLP secured the dismissal of all claims against its client, Elumeo SE, in a business tort action brought in the U.S. District Court for the Northern District of Georgia.​

Kat Florence, LLC—a company that markets, sells, and distributes fine jewelry—had alleged that Elumeo, a German online and television shopping jewelry distributor, tortiously interfered with Kat Florence’s relationship with Gem Shopping Network, Inc. and made false statements accusing Kat Florence of criminal activity related to its inventory. Elumeo moved to dismiss on several grounds, including lack of subject matter jurisdiction.​

In a detailed order issued on March 4, 2026, Judge Eleanor L. Ross granted Elumeo’s motion and dismissed the case, holding that Kat Florence failed to carry its burden to establish diversity jurisdiction under 28 U.S.C. § 1332. The Court agreed with Elumeo’s factual challenge under Rule 12(b)(1) of the Federal Rules of Civil Procedure, concluding that Kat Florence did not prove, by a preponderance of the evidence, that it was a citizen of any U.S. state at the time the complaint was filed.
