Sher Tremonte secures complete victory in multi-week jury trial in Nassau county commercial dispute

On March 10, 2026, Sher Tremonte LLP secured a complete victory on behalf of its clients following a three-week jury trial in the Commercial Division of the Nassau County Supreme Court.

Sher Tremonte represented investors Kim Volman and Simon Field, who had devoted years and millions of dollars to building an international fertilizer manufacturing and distribution company. Their co-investors sued, asserting claims for breach of contract, fraud, breach of fiduciary duty, embezzlement, and tortious interference. The Court had previously dismissed every claim except fraud, which proceeded to trial.

At trial, the plaintiffs alleged that Mr. Volman and Mr. Field fraudulently induced their investment by misrepresenting the company’s performance and providing false sales reports. They sought millions of dollars in damages.

Sher Tremonte demonstrated that its clients made no false statements and that all parties had equal access to company information, refuting the notion of deception. As associate Michael Bass noted in opening statement, the evidence showed that “everyone had access to the same information and everyone lost. There was no fraud.” Partner and co-founder Michael Tremonte reiterated in closing that, “sometimes businesses fail—and that’s what happened here. Our clients were truthful at all times.”

After less than a day of deliberations, the jury returned a verdict in favor of both defendants, rejecting all remaining claims.

This marks Sher Tremonte’s third trial in the past year. The firm’s trial team included partner and co-founder Michael Tremonte, associate Michael Bass, and paralegal Caroline Delafield.
